Who publishes this site #

https://www.ibimalik.com is published by Earthas DNCS OÜ, a private limited company registered in Estonia under company number 17406676, registered office Narva mnt 5, Kesklinna linnaosa, Tallinn 10117, Harju maakond, trading as Ibi Malik. In these terms, “we” and “us” mean Earthas DNCS OÜ.

What this site is #

A personal archive: photographs, handpan music, written and recorded reflections, and a podcast, published one month at a time. It is not a shop, a course, a newsletter or a consultancy. Nothing on it is professional advice of any kind, and nothing on it is an offer to sell you anything.

What you may do with the content #

Unless a page says otherwise, everything here — the photographs, the music, the writing, the recordings and the design — is owned by us or used with permission, and is protected by copyright and other laws of Estonia, the European Union and other countries.

You are welcome to:

read, listen to and watch anything on the site, for free, without an account;
link to any page here;
quote a short extract of the writing, with attribution to Ibi Malik and a link to the page it came from; and
share the podcast through the players and share links the platforms provide.

Podcast guests have their own, wider permissions, set out in the guest release.

What you may not do #

Without our written permission, please do not:

copy, republish, redistribute or mirror the photographs, the music or the video clips, in whole or in part, anywhere;
use anything from this site commercially, including in advertising or in any product or service;
alter or crop the work, or remove attribution from it;
pass any of it off as your own, or imply that we endorse you; or
use automated means to scrape, harvest or bulk-download the site, or place an unreasonable load on it.

Text and data mining is expressly reserved. We reserve all rights in the content of this site for the purposes of text and data mining, including for training or developing artificial intelligence or machine learning systems, under Article 4(3) of Directive (EU) 2019/790 and any equivalent provision elsewhere. No permission is granted for such use, and using the site does not imply one.

Names and logos #

“Earthas DNCS OÜ”, “Ibi Malik”, “Ibi’s Digital Nomad Stories” and our logo are our trade marks. Except as set out above, you may not use them, alone or with other words or designs, in any press release, advertisement, or promotional or marketing material, in any medium.

Other companies’ and people’s names and marks appear on this site for identification only. That does not mean they endorse the site or anything on it, and these terms give you no right to use their marks.

The people in the work #

The site publishes photographs of, and conversations with, real people who appear with permission. Please treat them accordingly: do not use their images or words to identify, contact, harass or profile them, and do not extract or republish material about them. How we handle personal data, including how anyone who appears here can ask for something to be changed or removed, is set out in the privacy policy.

Your privacy #

We handle personal data as described in our privacy policy, which forms part of these terms. In short: this site sets no cookies, runs no analytics, and asks you for nothing.

Accessibility #

We want the site to be usable by as many people as possible. Where it currently falls short, and how to tell us about a problem, is set out in the accessibility statement.

The site is provided as it is #

We take care over what is published here, but the site is provided as it is and as available. We make no representations or warranties about it, express or implied. In particular we do not warrant that it will be uninterrupted, error-free, secure, or free from viruses or malicious code, or that anything on it is complete or up to date. To the fullest extent the law allows, we exclude the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, compatibility, security and accuracy.

Limits on our liability #

To the fullest extent permitted by law, we are not liable for any indirect, special, incidental, consequential or punitive damages, or for any loss of data, profit, business or goodwill, arising out of or relating to your use of this site, whether the claim is made in contract, tort (including negligence), under statute or otherwise, and even if we knew such loss was possible.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, these terms do not affect your statutory rights.

If part of these terms does not hold #

If any part of these terms is found invalid or unenforceable in a country, it is to be read as narrowly as needed to make it valid there while keeping its intent, and the rest of the terms continue in full force — in that country and everywhere else.

A delay in enforcing any part of these terms is not a waiver of it.

Changes to these terms #

We may revise these terms by posting the revised version on this page. The date at the top is when they last changed. Revisions take effect when posted, and continuing to use the site means you accept them.

Governing law #

These terms are governed by the law of Estonia and of the European Union. Disputes arising out of or in connection with them are subject to the jurisdiction of the Estonian courts. If you are a consumer resident elsewhere in the EU, this does not deprive you of the protection of the mandatory law of your own country.
